HERBEAST TERMS OF SERVICE

Last updated: 7 September 2026

1. About Herbeast and these Terms

Herbeast is a trading name of Shanghai Wanxiang Heyi Cosmetics Co., Ltd. (上海万相合一化妆品有限公司) ("Herbeast", "we", "us", or "our"). We operate the website at www.herbeast.world and the related online store, content, features, products, and customer services (together, the "Services").

These Terms of Service (the "Terms") govern your access to and use of the Services and any order you place with us. They should be read together with our Privacy Policy (https://www.herbeast.world/policies/privacy-policy), Refund Policy (https://www.herbeast.world/policies/refund-policy), and Shipping Policy (https://www.herbeast.world/policies/shipping-policy), as well as any product-specific instructions or notices shown on the website or packaging.

By using the Services, continuing to use an account, or placing an order, you agree to these Terms. If you do not agree, please do not use the Services or place an order.

Nothing in these Terms excludes, restricts, or changes any consumer guarantee, statutory warranty, right, remedy, or liability that cannot lawfully be excluded, restricted, or changed. If there is a conflict between these Terms and a mandatory law that applies to you, the mandatory law will prevail.

2. Eligibility and accounts

You may browse our public website regardless of age. To create an account or place an order, you must be at least 18 years old and legally able to enter into a binding contract where you live. If you are under 18, a parent or legal guardian must place the order for you.

Products intended for use by a minor should be selected and used under the responsibility of a parent or legal guardian and in accordance with the product label and any age or safety guidance provided with the product.

If you create an account, you must provide accurate and current information and keep your login details secure. You are responsible for activity carried out through your account unless it results from our failure to use reasonable security measures. Please notify us promptly if you believe your account has been accessed without permission.

Accounts are personal and may not be sold, transferred, or licensed to another person.

3. Product information and use

We take reasonable care to describe and display our products accurately. Screen settings, lighting, packaging updates, and the natural variation of botanical ingredients may cause colours, textures, or appearance to differ slightly from images shown online. These variations do not affect your rights if a product is faulty, unsafe, not as described, or otherwise fails to meet a mandatory legal standard.

All ingredients, usage directions, warnings, and product-specific restrictions provided on the website or packaging form part of the product information. Please read and follow them before use. Where a patch test is advised, perform it as directed. Stop using a product and seek appropriate professional advice if you experience a significant or unexpected reaction.

Our cosmetic and wellness content is provided for general informational purposes. It is not medical advice and is not intended to diagnose, treat, cure, or prevent a disease. If you have a medical condition, known allergy, are pregnant or nursing, or have questions about whether a product is suitable for you, consult an appropriately qualified professional.

We may improve or discontinue products and may update descriptions before an order is placed. Any material change affecting an accepted order will be communicated to you and will not be made without your agreement where the law requires it.

Products purchased through the Services are intended for personal or household use, not unauthorised commercial resale or export.

4. Orders and contract formation

Your order is an offer to purchase the products in your basket. After you submit an order, we will send an acknowledgement confirming that we received it. An acknowledgement is not acceptance of your order.

Our contract with you is formed when we send you a dispatch confirmation, unless applicable law requires it to be formed earlier. The contract covers only the products identified in that dispatch confirmation.

We may refuse or cancel an order before dispatch for a legitimate reason, including suspected fraud, unauthorised resale, an obvious pricing or product-information error, stock unavailability, delivery restrictions, or inability to obtain payment authorisation. We will notify you and promptly refund any amount already collected for products we do not supply.

Please review your order before submitting it. If you wish to change or cancel it, contact us promptly at orders@herbeast.world. We will try to help, but an order that has entered fulfilment may need to be handled as a return. This does not limit any statutory cancellation right.

5. Prices, payment, taxes, and import charges

The price payable is the price displayed at checkout when you place your order. Unless the website or checkout states otherwise, prices are displayed and charged in US dollars. Available payment methods will be shown at checkout. We may obtain payment authorisation when you order and collect payment before or when the products are dispatched, depending on the payment method and local requirements.

Prices, promotions, and availability may change before you place an order. Changes will not affect an order we have already accepted, except where we correct an obvious error and the law permits us to do so. If a promotion has separate terms, those terms will apply to the promotion. If they conflict with these Terms, the promotion terms will govern only in relation to that promotion.

Before you submit an order, checkout will show the product price, delivery charge, applicable taxes we are required to collect, and any other charge payable to us. For UK consignments where Herbeast is legally required to collect VAT at the point of sale, the applicable VAT will be included or displayed and collected at checkout.

Orders are fulfilled from China. A shipment may be subject to import VAT, customs duty, brokerage fees, or similar charges in the destination country. Where these charges are not collected by us at checkout, we will clearly indicate this before you place the order. You are responsible for destination-country import charges only where this was disclosed before purchase and applicable law allows it. You must provide information reasonably required for lawful customs clearance.

6. Shipping, delivery, title, and risk

We currently ship to addresses in the United Kingdom and the United States that are accepted at checkout. Available shipping methods, charges, restrictions, and estimated delivery times are shown at checkout and further explained in our Shipping Policy.

Delivery dates are estimates unless we expressly agree to a guaranteed date. We are responsible for fulfilling the order and will notify you if we cannot ship within the period promised at checkout or otherwise required by law. Where required, we will offer a revised date and the option to cancel affected products for a prompt refund.

We may use third-party warehouses and carriers. Our current fulfilment facility is in Dongguan, Guangdong, China. A carrier's involvement does not remove responsibilities that the law places on us.

Except where you independently arrange a carrier that we did not offer, risk of loss or damage passes to you when you, or a person identified by you other than the carrier, takes physical possession of the products. Title passes when we have received full payment and the products are delivered, except where applicable law provides otherwise.

Please contact us promptly if a shipment is missing, materially delayed, damaged, or incomplete so we can investigate and provide the remedy required by law.

7. Returns, cancellations, and refunds

In addition to any mandatory rights, you may request a change-of-mind return by contacting orders@herbeast.world within 15 days after you receive the product. We will provide return instructions and, where applicable, a return authorisation. Products must be sent back within 14 days after you tell us that you are returning them, unless we agree otherwise.

To qualify for a change-of-mind return, a product must be unused, unopened, in its original condition and packaging, and accompanied by proof of purchase. For health and hygiene reasons, we may decline a change-of-mind return of a sealed skincare, cosmetic, personal-care, or wellness product after its seal has been broken, but only where the law permits this exception. This restriction does not apply merely because you opened external delivery packaging, and it does not limit your rights concerning a faulty, damaged, unsafe, misdescribed, or incorrect product.

Unless the product is faulty, damaged, unsafe, misdescribed, incorrect, or the law requires otherwise, you are responsible for the cost of a change-of-mind return. We are responsible for reasonable return costs where the return results from our error or a product's failure to meet a mandatory legal standard.

If you validly cancel an entire order under a statutory cancellation right, we will refund the product price and any standard outbound delivery charge where required by law. Additional amounts paid for premium or expedited delivery may not be refundable beyond the cost of standard delivery.

Refunds will be issued to the original payment method as soon as reasonably possible and within any legally required period. We may wait until we receive the returned products or evidence that they were sent, where permitted by law. We may reduce a refund only to the extent permitted by law, including for handling beyond what is reasonably necessary to inspect the nature, characteristics, and functioning of a product.

For UK consumers, the 15-day Herbeast return period includes and extends the ordinary 14-day period in which eligible distance purchases may be cancelled. UK consumers ordinarily then have a further 14 days to return the goods. Your rights regarding faulty or misdescribed goods are separate and are not limited to 15 days.

More operational details, including exclusions and return instructions, appear in our Refund Policy. If that policy conflicts with this Section or mandatory law, this Section and the mandatory law will prevail.

8. Intellectual property

The Services and their original content, including our branding, trademarks, designs, text, photographs, graphics, audio, video, software, and selection and arrangement of materials, are owned by or licensed to Herbeast and are protected by applicable intellectual property laws.

We grant you a limited, revocable, non-exclusive, non-transferable right to access and use the Services for lawful personal and non-commercial purposes. You may not reproduce, distribute, publicly display, modify, sell, license, create derivative works from, or commercially exploit our content without our prior written permission, except where the law expressly permits it.

"Herbeast," its logos, product names, designs, and slogans are trademarks of Herbeast or its licensors. Shopify's names and marks belong to Shopify. Other third-party names and marks belong to their respective owners. No licence to use any trademark is granted by these Terms.

9. Reviews, feedback, and user content

If you submit a review, photograph, comment, suggestion, or other content ("User Content"), you retain ownership of any rights you hold in it. You grant us a non-exclusive, worldwide, royalty-free, sublicensable licence to host, reproduce, adapt for formatting, translate, publish, display, distribute, and use that User Content to operate, improve, and promote Herbeast and the Services. This licence continues for as long as reasonably necessary for those purposes, subject to applicable privacy and consumer laws.

You confirm that you have the rights needed to submit the User Content; that it is accurate to the best of your knowledge; that you have disclosed any incentive or material connection associated with a review; and that it does not infringe another person's rights or contain unlawful, abusive, deceptive, or malicious material.

We may moderate or remove User Content for a legitimate reason, including illegality, abuse, infringement, irrelevance, fraud, or violation of these Terms. We will not materially change the meaning of a customer review. We do not promise to publish or respond to every submission.

10. Third-party services and links

The Services may contain links to, integrations with, or features provided by third parties. Their own terms and privacy notices may apply. We do not control independent third-party websites and are not responsible for their content, security, or separate transactions. This does not exclude responsibility for a third party acting as our agent or service provider where the law makes us responsible.

11. Shopify

Our online store is powered by Shopify, which provides technology used to operate the Services. Products purchased from the Herbeast store are sold by Herbeast, not Shopify. Herbeast is responsible for product information, order acceptance, fulfilment, customer service, returns, and refunds. Shopify is not a party to the sales contract between you and Herbeast and is not responsible for Herbeast products or fulfilment, except to the extent applicable law provides otherwise.

Shopify may process personal information to provide its technology and related services. Please see our Privacy Policy for information about how Herbeast, Shopify, and our other service providers process personal information.

12. Acceptable use and automated tools

You must use the Services lawfully and must not:

• infringe intellectual property, privacy, publicity, or other rights;
• submit false, fraudulent, defamatory, threatening, abusive, or unlawful material;
• impersonate another person or misrepresent your identity or authority;
• introduce malware or interfere with the availability, integrity, or security of the Services;
• circumvent access controls, rate limits, CAPTCHAs, robot-exclusion measures, or other protective measures;
• collect personal information about others without a lawful basis;
• send spam or unauthorised advertising;
• scrape or extract content at scale, build a commercial dataset from the Services, or use Herbeast content to train a machine-learning model without our written permission; or
• place fraudulent, unauthorised, or abusive orders.

Public search-engine indexing and personal AI or digital assistants may access public parts of the Services and assist an individual user, including with a purchase, when acting on that user's express instruction. Such tools must comply with these Terms, must not conceal their automated nature when identification is technically supported or requested, and must not circumvent protective measures, create excessive traffic, or act without the user's authorisation. We may reasonably restrict automated access that threatens security, availability, customer privacy, or our legitimate commercial interests.

13. Privacy

Our collection and use of personal information are described in our Privacy Policy. The Privacy Policy is a notice explaining our practices and is not intended to reduce any right you have under applicable data-protection or privacy law.

Information may be processed by Shopify and other service providers and may be transferred to countries other than the country where you live, subject to the safeguards and legal requirements described in the Privacy Policy.

14. Suspension and termination

We may suspend or terminate an account or restrict access to the Services where we reasonably believe this is necessary to address fraud, unlawful conduct, security risk, material breach of these Terms, abuse of the Services, or a legal requirement. Where reasonably possible, we will provide notice and an opportunity to address the issue.

Suspension or termination does not affect accepted orders, refunds, returns, accrued rights, payment obligations, or consumer protections unless cancellation is lawful and we provide any required refund.

Sections that by their nature should continue after termination will remain effective, including those concerning intellectual property, User Content, liability, governing law, and accrued payment obligations.

15. Availability and website information

We aim to keep the Services available and accurate, but we do not promise that the website will always be uninterrupted, secure, or error-free. We may temporarily suspend features for maintenance, security, legal, or operational reasons.

General editorial, cultural, ingredient, ritual, and wellness content is provided for information and inspiration. You should not rely on it as professional medical, legal, financial, or other regulated advice.

These limitations do not apply to contractual product descriptions or information that applicable law requires us to provide accurately.

16. Liability

Nothing in these Terms excludes or limits liability for:

• death or personal injury caused by negligence;
• fraud or fraudulent misrepresentation;
• wilful misconduct or gross negligence where it cannot lawfully be limited;
• defective or unsafe products to the extent liability cannot lawfully be limited;
• breach of mandatory consumer rights; or
• any other liability that cannot lawfully be excluded or limited.

If we fail to comply with these Terms, we are responsible for loss or damage that is a reasonably foreseeable result of our breach or failure to use reasonable care and skill. We are not responsible for loss that was not reasonably foreseeable when the contract was formed.

The Services and products are offered to consumers for personal and household use. To the extent permitted by law, we are not responsible for business losses, including lost profits, revenue, business opportunities, goodwill, or business data, arising from a consumer's unauthorised commercial use of the Services or products.

17. Your responsibility for third-party claims

To the extent permitted by applicable law, you are responsible for a third-party claim, loss, or reasonable cost directly caused by your unlawful use of the Services, deliberate infringement of another person's rights, fraud, or material breach of these Terms.

We will notify you of such a claim within a reasonable period and will not agree to a settlement that imposes a non-monetary obligation on you without your consent. Nothing in this Section requires a consumer to compensate us for losses caused by Herbeast, Shopify, or another service provider.

18. Events outside reasonable control

Neither party is responsible for a delay or failure caused by an event outside its reasonable control, provided the affected party takes reasonable steps to reduce the impact. This Section does not remove any right to cancel, receive a refund, or obtain another remedy that applicable law gives you because of delayed or failed delivery.

19. Changes to the Services and these Terms

We may update these Terms for legal, security, operational, or service-related reasons. The updated Terms will be posted with a revised date. Where required by law, we will give reasonable notice of a material change.

Changes apply prospectively. The version in effect when we accept an order will continue to govern that order unless a change is required by law or you expressly agree otherwise.

20. Assignment

You may not transfer your rights or obligations under these Terms without our written consent, although you may transfer a product or any transferable product warranty where applicable law allows it.

We may transfer our rights and obligations to an affiliate, purchaser, or successor in connection with a reorganisation or sale of all or part of our business, provided the transfer does not reduce your rights. We will notify you where required by law.

21. Severability

If a provision of these Terms is found unlawful, invalid, or unenforceable, it will be enforced to the maximum extent lawful or removed to the minimum extent necessary. The remaining provisions will continue in effect.

22. No waiver and entire agreement

If either party delays enforcing a right, that does not waive the right. A waiver is effective only for the specific circumstances in which it is given.

These Terms and the policies and product-specific terms expressly incorporated into them form the agreement between you and Herbeast concerning the Services and your purchases. They do not exclude representations or rights that cannot lawfully be excluded.

23. Governing law and disputes

Please contact us first at hello@herbeast.world so we can try to resolve any concern promptly. This request does not prevent either party from exercising a legal right or remedy.

These Terms and non-contractual disputes connected with them are governed by the laws of the People's Republic of China, without regard to conflict-of-laws principles. The courts of Shanghai, China have non-exclusive jurisdiction.

If you are a consumer, this choice does not deprive you of mandatory protections available under the laws of the country or state where you ordinarily reside. It also does not prevent you from bringing proceedings in a competent local court where that right cannot lawfully be waived.
